Terms & Conditions (Human Language Edition)

We aren't all lawyers, so here's what you're agreeing to in real words when you join a tour with Tour Guys:

  1. I’m doing this tour because I want to. Nobody’s making me. I feel fine and am healthy enough to walk around.

  2. If something goes wrong—like I trip, get sunburned, or choke on a street hot dog—I get that it’s not the company’s fault.

  3. I’m responsible for myself. If I lose my phone, get a blister, or end up in a TikTok background, that’s on me.

  4. I can’t sue the company unless they do something outrageously stupid or intentionally harmful. And even then, the most I can get is $400 CAD. Not $401. Not a Tesla. Four. Hundred. Bucks.

  5. If I need medical help, the company can assist—but they’re not required to, and I’m still paying the bill.

  6. If one part of this agreement turns out to be legally unenforceable, the rest of it still stands.

  7. Tour Guys owns all the photos, videos, and recordings made on the tour. They can use my image or quotes to promote their tours forever, anywhere, without paying me. Basically, I'm not getting royalties for looking fabulous.

  8. If I show up late or ghost the tour completely, that’s on me. No refunds, no rescheduling, no do-overs.

  9. If the tour is cancelled or changed due to things like weather, war, or a swarm of angry geese, that’s not the company’s fault.

  10. I won’t try to record or reuse Tour Guys content or guide commentary for my own tour business, podcast, or stand-up routine without permission. That’s just tacky.

  11. If I'm bringing someone under 18, I promise I’m their parent or guardian, and I agree to all this on their behalf too.

Terms & Conditions (Legal Version)

Please read the below Waiver & Release of Claims carefully. If you are booking a tour for someone else, please make sure they also read this.

By purchasing tickets for and/or participating in walking tours (“Tours”) offered by Tour Guys (the “Company”), and in consideration of being allowed to participate, I (and, if under 18, my parent or legal guardian) agree to the following Waiver:

​

1. Voluntary Participation

I understand that participating in a Tour is voluntary. I confirm I am in good health and do not suffer from any condition that would put me at increased risk of injury or illness during the Tour.

​

2. Comprehension of Risk

I understand that Tours involve risks, including but not limited to: slips, trips, weather exposure, food allergies or illness, vehicle accidents, and other hazards in public spaces. I acknowledge that these risks are largely outside the Company’s control.

3. Assumption of Risk

I knowingly assume all risks, known and unknown, connected to participating in the Tours. I accept full responsibility for my own well-being, belongings, and choices.

​

4. Release of Liability; Limitation of Damages

I release the Company and all related entities and personnel (“Released Entities”) from liability for any injuries, damages, losses, or claims, including those resulting from negligence. The Company’s liability is strictly limited to $400 CAD, and only in the case of gross negligence or intentional misconduct. This is my sole and exclusive remedy. I waive all rights to special, punitive, indirect, or incidental damages.

5. Consent to Medical Treatment

I authorize the Company to obtain emergency medical services for me if needed. This does not mean they are responsible for doing so, nor does it mean they will pay for any services rendered.

6. Severability

If any part of this Waiver is found to be unenforceable, the rest remains valid. The invalid section will be revised only to the extent necessary to make it enforceable.

7. Promotional Release

I grant the Company full rights to use photos, video, audio, and any recordings of me taken during the Tour. This includes use in marketing, social media, publications, or any future projects. I waive any rights to royalties or approval of how I appear. The Company owns all such material.

8. No-Show & Late Arrival Policy

I understand that if I arrive late or fail to attend the Tour, I am not entitled to a refund, reschedule, or credit.

9. Force Majeure

The Company is not responsible for cancellations or changes caused by events beyond its control, including but not limited to severe weather, pandemics, strikes, war, government restrictions, or public safety issues.

​

10. Unauthorized Use

I will not record, reproduce, reuse, or distribute the Tour content for commercial purposes without express written permission. This includes guide commentary, stories, routes, or media.

11. Governing Law and Jurisdiction

This Waiver is governed by the laws of Ontario and Canada. Any disputes must be resolved in the courts located in Ontario. I agree to submit to the jurisdiction of those courts.

THIS IS A WAIVER AND RELEASE OF LIABILITY. I HAVE READ AND UNDERSTAND ITS CONTENTS. By participating, I voluntarily agree to these terms. If I am bringing a minor, I confirm I have authority to agree on their behalf.
